These Terms and Conditions govern your use of the Tomte service, including the mobile application, caregiver portal, and associated messaging services. By using Tomte, you agree to these terms.
Please read these terms carefully. If you do not agree with any part of these terms, you should not use the Tomte service.
1. Service Description
1.1 Program Name

1.2 What Tomte Does
Tomte is a voice-first AI companion service designed for older adults and people with cognitive impairments. The service provides:
- Natural voice conversations through a tablet device
- Long-term conversational memory and personalization
- Safety alert notifications to designated caregivers via SMS and push notifications
- Medication and appointment reminders
- Photo integration and memory support
- Offline functionality when internet connectivity is unavailable
1.3 Eligibility
The Tomte service is intended for use by adults. Caregivers who set up and manage the service must be at least 18 years old. End users (the individuals receiving care) may be of any age, provided they have a designated caregiver managing their account.
2. Messaging Service Terms
Tomte sends SMS text messages and push notifications to caregivers as part of its safety alert system and reminder features. By providing your mobile phone number and enabling notifications, you consent to receive these messages.
2.1 Message Frequency
Message frequency varies and depends on the reminders and safety alerts configured in your caregiver portal. The number of messages you receive is based on:
- Safety alerts triggered by the user's conversations (e.g., mentions of pain, falls, distress)
- Scheduled medication and appointment reminders you have configured
- Check-in reminders and missed check-in alerts
- Important system notifications and updates
You have full control over which alerts and reminders are enabled through the caregiver portal settings.
2.2 Message and Data Rates
Standard message and data rates may apply. Tomte does not charge for SMS messages, but your mobile carrier may charge you for text messages and data usage according to your mobile plan. Please check with your carrier for details about your plan's messaging and data rates.
2.3 Supported Carriers
Tomte's messaging service is available on all major U.S. and international carriers. If you experience issues receiving messages, please contact our support team.
3. Opting Out of Messages
You may opt out of receiving SMS messages from Tomte at any time through the following method:
- Caregiver Portal Settings — Log in to your caregiver portal at www.meettomte.com and adjust your notification preferences. You can disable SMS notifications while keeping push notifications enabled, or disable all notifications entirely.
Important: Disabling safety alert notifications may prevent you from being notified of urgent situations involving your loved one. We recommend keeping at least one notification method enabled.
If you disable notifications and later wish to re-enable them, you can do so at any time through the caregiver portal settings.

Our support team will respond to inquiries within 1-2 business days. For urgent safety concerns, please contact emergency services (911 in the U.S.) directly rather than waiting for a response from our support team.
5. Account and Service Terms
5.1 Account Creation
To use Tomte, you must create a caregiver account through our onboarding process. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
5.2 Service Availability
We strive to provide reliable, uninterrupted service, but we cannot guarantee that Tomte will be available at all times. Service may be temporarily unavailable due to:
- Scheduled maintenance or updates
- Technical difficulties or system failures
- Internet or cellular network outages
- Circumstances beyond our reasonable control
Tomte includes an offline mode that continues to function when internet connectivity is unavailable. However, safety alerts cannot be delivered to caregivers when the device is offline.
5.3 Acceptable Use
You agree to use Tomte only for its intended purpose: providing companionship, safety monitoring, and support for older adults or individuals with cognitive impairments. You agree not to:
- Use the service for any unlawful purpose
- Attempt to interfere with or disrupt the service
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service to harass, abuse, or harm others
- Reverse engineer, decompile, or otherwise attempt to extract source code from the service
6. Limitations and Disclaimers
6.1 Not a Medical Device
Tomte is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is a companion service designed to provide conversation, memory support, and basic safety monitoring.
Tomte's safety alert system is designed to notify caregivers of potential concerns, but it:
- May not detect all emergency situations
- May generate false alerts or miss genuine emergencies
- Should not be relied upon as the sole method of emergency response
- Is not a substitute for professional medical care or in-person supervision
For medical emergencies, always call 911 or your local emergency services immediately.
6.2 AI-Generated Content
Tomte uses artificial intelligence to generate conversational responses. While we strive for accuracy and appropriateness, AI-generated content may occasionally be:
- Inaccurate or incomplete
- Misinterpreted by the user
- Inconsistent with previous responses
Users and caregivers should exercise judgment and not rely solely on information provided by Tomte for important decisions, especially those related to health or safety.
6.3 Limitation of Liability
To the maximum extent permitted by law, Tomte and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to:
- Missed or delayed safety alerts
- Inaccurate or inappropriate AI-generated responses
- Service outages or technical failures
- Data loss or security breaches despite our security measures
7. Privacy and Data
Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Fees and Payment
Tomte is currently in development and not yet available for general use. Pricing and payment terms will be provided when the service launches.
Any future fees will be clearly communicated before you are charged. You will have the opportunity to review and accept pricing terms before committing to paid service.
9. Termination
9.1 Termination by You
You may terminate your Tomte account at any time through the caregiver portal or by contacting our support team. Upon termination:
- Your access to the service will be immediately disabled
- All personal data will be deleted in accordance with our Privacy Policy
- Any prepaid fees may be refunded on a pro-rata basis (if applicable)
9.2 Termination by Us
We reserve the right to suspend or terminate your access to Tomte if:
- You violate these Terms and Conditions
- You fail to pay applicable fees (when service becomes paid)
- We determine that continued service poses a risk to us or other users
- We discontinue the Tomte service entirely
We will provide reasonable notice before terminating service except in cases of serious violation or legal requirement.
10. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our service, legal requirements, or business practices. When we make changes:
- We will update the "Last updated" date at the top of this page
- For significant changes, we will notify you via email and through the caregiver portal
- Your continued use of Tomte after changes take effect constitutes acceptance of the updated terms
If you do not agree with updated terms, you should discontinue use of the service and close your account.
11. Governing Law
These Terms and Conditions are governed by the laws of the United States and the state in which Tomte's principal business operations are located, without regard to conflict of law principles.
Any disputes arising from these terms or your use of Tomte shall be resolved through binding arbitration, except where prohibited by law.
